The Northampton Board of Supervisors have approved two ordinances they hope will avoid another cell tower fight.
The Northampton Township Board of Supervisors on Wednesday approved two ordinances that they hope will prevent a battle similar to the one fought with American Tower Corporation. Last year, dozens of Northampton residents were outraged when the private company began installing new towers in their neighborhoods without notification. A settlement was reached between the township and the company but now local officials are taking steps to ensure a similar situation does not reoccur. The ordinances include a telecommunications facilities ordinance and a right-of-way management ordinance. Representatives from the American Tower Company are preliminarily agreeing to relocate 12 cell phone towers after an outcry from Northampton residents.
Several dozen Northampton residents attended a special meeting with the Board of Supervisors and American Tower Corporation at Richboro Middle School Monday evening. At the meeting—the first that ATC officials have publicly attended—representatives from the large telecommunications company laid out preliminary plans to relocate 12 poles to other locations from neighborhoods that have no above-ground utilities. Already installed poles that are in neighborhoods with above-ground utilities will stay for the time being. Nearly 40 Northampton residents filled Courtroom 1 in Doylestown on Tuesday, June 19.
Lawyers representing American Tower Corporation (ATC) and Northampton Township met in county court in Doylestown on Tuesday and received signed permission from a judge for a stay of proceedings so the involved parties can work to negotiate a solution. The township, ATC and Citizens of Northampton Township Against Cell Towers (CONTACT) have until August 31 to work toward a solution to the Distributed Antenna System issue that has mobilized the community in recent months, according to township solicitor Michael Savona. The township's fight with American Tower Corporation (ATC) continues in county court today. Northampton's Board of Supervisors and representatives from ATC will meet at 1:30 p.m. in courtroom 1 at the Bucks County Court House, located at 55 E Court St., in Doylestown. In May, the township pulled ATC’s work permit and the company immediately stopped installing 60 small cell towers on residential properties throughout Northampton. The holes dug by ATC crews have been secured by township work crews.
The empty holes left behind by ATC and its contractors on the yards of homeowners have been secured by Northampton public works crews, according township officials. After ATC received word that Northampton Township had pulled the work permits, the company removed it's equipment and crews leaving the holes that were meant for poles open and posing a risk to the general public. Public works employees took to the streets and covered the holes with wood board and placed cones over top. The fate of the holes will have to wait until the legal fight over whether or not the remaining poles can be erected in the right-of-way has been settled, township officials surmised at last week's board meeting. While work on the 60 poles has ceased, the fight is far from over.
At Wednesday night’s Board of Supervisors meeting, Northampton Township solicitor Michael Savona gave residents an update on where the township stood in its fight against American Tower Corporation (ATC) installing 60 small cell towers on residential properties throughout Northampton. The township has filed papers in U.S. District Court for Eastern Pennsylvania in Philadelphia requesting a judge rule that ATC’s 60 Distributed Antenna System (DAS) units mounted on poles should be classified as cell towers. If classified as cell towers, the United States Telecommunications Act would allow township zoning ordinances to designate where the DAS units could be placed, Savona said. During a special Board of Supervisors meeting Tuesday evening at Richboro Middle School, Northampton Township officials announced they will meet Wednesday morning to find a justifiable cause to revoke the permit that allows American Tower Corporation to install pole-based distributed antenna systems and nearly 40 miles of fiber optic cables across the township. Revoking the permits will effectively cause ATC crews to stop working in the township. The measure, which the board unanimously approved, was first introduced by current supervisor and former chairman George Komelasky.
