Trial for Teacher Accused of Shooting at Teens Continues

It is alleged a Northampton man fired a gun at two teens after they trespassed on his yard.

David Kelly, 43, of the 1000 block of Bridgetown Pike, is standing trial on charges that he fired a a rifle at two 15-year-old boys, who were cutting through his property to go fishing in the Neshaminy Creek in August of last year.

Yesterday in the court, the two teens testifyed that Kelly, a music teacher at Lawrence Township Middle School in New Jersey, appeared to be intoxicated and in a very aggressive mood when he came out of his home; minutes later they claim they heard two gunshots, according PhillyBurbs.com.

Kelly claims he fired the gun by mistake and did not mean to shoot at the teens.

Today, a private eye told the court he investigated the incident and discovered the bullet from Kelly's gun and can prove it was fired by mistake, the article states.

Aggravated Assault With Gun at the 1000 block of Bridgetown Pike

At 8:02 p.m. officers responded to a report of an armed subject who had fired two shots at two juveniles in the area of Bridgetown Pike and Woodstream Drive. On arrival officers spoke with the two 15-year-old victims who stated that while walking through a property on Bridgetown Pike to go fishing at an adjacent creek, a male who appeared to be intoxicated screamed at them stating he had guns and telling them where they could walk. When the victims left the subject's property they heard two gunshots and noticed the subject then had a rifle. The youths then ran into the woods and ran home where they then called police. The victims were able to identify the home where the actor had been and were subsequently able to identify the actor. The actor was identified as David Kelly, 43, of Langhorne (Northampton Township). Kelly was taken into custody and a .22 cal rifle was located in the homes basement. Kelly was transported to the Bensalem Township Police Department for processing and arraignment before District Judge Seaman. Kelly was charged with Terroristic Threats, Simple Assault with a Deadly Weapon, Possession of an Instrument of Crime, Recklessly Endangering Another Person and related offenses. DJ Seaman set bail at $100,000 (10 percent) and remanded Kelly to the Bucks County Correctional Facility.
